ABC's Fan February Contest
No Purchase Necessary To Enter or Win. Eligibility: Promotion open to legal residents of the fifty United States and the District of Columbia, 18 years of age or older.
1. Contest Entry: ABC's Fan February Contest (the "Promotion" or "Contest") begins at 12:01 am ET 12/18/2006 and ends at 11:59 pm ET on 12/31/2006. American Broadcasting Companies, Inc.'s computer is the official clock for this Contest. To enter, navigate the Internet and visit www.abc.com keyword: "fan february" and click on the icon that will take you to the "Fan February Contest" home page.
Step 1 (Registration): You must be a registered member of ABC.com to enter or you may become a member. Registration is free and only required once. Enter as follows: a) if you are an existing ABC.com member, simply sign in on the Contest home page with your current member name and password. No other additional information will be requested or required; or b) if you are not an ABC.com member, you can register by clicking on the link located on the Contest home page. You will be asked to provide your name, mailing address with zip code, e-mail address, gender, birthday, country, and to select a password. You may be asked to consent to receive promotional e-mails and reminders for upcoming ABC.com promotions. Consenting to receive promotional or reminder e-mails is optional, does not have to be agreed to in order to be eligible to enter the Contest. In the event you do consent to receive these e-mails, the use of such e-mails shall be subject to the privacy policy of ABC.com and you may opt out of receiving these e-mails at any time. Step 2 (Submission of Essay): After signing in or registering as a member of ABC.com, type your essay in the text box portion of the entry form. Essay should include no more than 75 words. Essay should describe why you are the biggest fan of ABC Daytime and tell us your favorite show (i.e One Life To Live, All My Children, or General Hospital). You should also describe what your job is and why your job would make for a good swap with your favorite ABC actor.
Step 3 (Submission of Photograph): Attach a file with a color photograph no larger than 4" x 6" in physical size (and no larger than 3MB in file size) of yourself, showing us why you're a big fan. Send your entry by clicking the submit button on the Contest page. Alternatively, you may instead submit your photograph by mail. Be sure to check the "Will Submit Photo By Mail" box on the entry form before clicking the submit button; if box is not checked, you have indicated that the photograph will be submitted on-line, as a file attachment. Without the attachment, entry will be deemed incomplete and will be disqualified. When submitting photograph by mail, photo must be no larger than 4 inches by 6 inches (4" x 6"). Print your name, address and daytime telephone number on the back of the photograph and on a 3" x 5" card/paper accompanying the photograph. Mail to "Fan February Contest" Photo Submission, 159 West 25th Street, 2nd Floor, New York, NY 10001. It is recommended that you make a copy of photograph for your records prior to submission. You may only submit one photograph either by mail or on-line, NOT both. Duplicate or numerous photo submissions will be considered multiple entries and will cause all your entries to be disqualified.
2. Entry Restrictions: Limit one entry (sign in/registration with ABC.com, essay, and photograph) per person/e-mail address. Multiple entries will result in the disqualification of all of your entries. American Broadcasting Companies, Inc., ("Sponsor") will not be responsible for late, lost, incomplete, illegible, damaged, garbled or misdirected entries or late, lost, incomplete, misdirected or postage due materials. All entries (or on-line portions of entries, if photograph is submitted via mail) must be received by 11:59 pm ET on 12/31/06. If submitted via mail, photograph must be received by 1/5/07. All entry materials, including any original photos, become the property of Sponsors and will not be acknowledged or returned. It is the sole responsibility of the entrant to notify LD Marketing Group ("LD") in writing if the entrant changes his/her e-mail address. (To do so, write to: "Fan February Contest" Change of Address, 159 West 25th Street, 2nd Floor, New York, NY 10001. Notification must be received by 1/5/07). By entering this Contest, participants agree to these Official Rules and the decisions of judges and Sponsors, which are binding and final in all matters relating to this Contest.
Essay must fit entirely within text box portion of entry form and can be no more than 75 words in length; essay MUST be submitted on-line. Use of any other means to submit essay (such as, submission by postal mail, via e-mail message or file attachment) is prohibited. If photograph is submitted on-line, file attachment with photograph must be in one of the following formats: JPEG, GIF or PDF File attachment must only include photograph itself; do NOT add any commentary or additional material to file attachment. Photograph and essay must be the original work of entrant; do NOT copy the works of others. Photograph must have been taken within the last year. Essay must be completely the original work of entrant; do NOT copy the works of others. Essay must not violate the trademark, copyright or other rights of person(s) or owner(s) of property included/referenced therein. If Sponsor, in their sole discretion, has reason to believe that an Essay contains any material that may infringe or violate the rights of a third party, Sponsor may disqualify such entry and take all other measures as Sponsor deem appropriate so as to protect their rights. Essay must not have been submitted to any other contest or competition. Essay (and entrant submitting same) will be disqualified if it features any content determined by Sponsor or the judges, in the sole discretion of any party, as indecent, inappropriate, morally objectionable or otherwise unfit for publication or broadcast. Entries not satisfying these Official Rules in any respect will be disqualified. By submitting an entry, you understand and agree that the Essay will become and remain the sole property of American Broadcasting Companies, Inc., including any future rights associated with the entry. In submitting an entry, you expressly disclaim any and all ownership rights of the essay, and you acknowledge and agree that American Broadcasting Companies, Inc. has an unrestricted right to use the Essay (or materials or ideas similar to the Essay) in any medium, now and in the future, without notice, compensation or other obligation to you or any other person. In the alternative, you grant (and agree to confirm in writing, upon American Broadcasting Companies, Inc.'s request) American Broadcasting Companies, Inc. the royalty-free, perpetual, irrevocable, non-exclusive right (including any moral rights) and license/consent to use, publish, or create derivative works from the Essay (in whole or in part, with or without attribution to you) worldwide in any form or medium, for the full term of any copyrights, trademarks, and other intellectual/proprietary rights that may exist in the Essay.
3. Eligibility: Promotion is open only to legal residents of the 50 United States and D.C. who are 18 years of age or older as of the date of entry. Void in Guam, Puerto Rico, U.S. Virgin Islands and other U.S. Territories, and where prohibited by law. Any individuals (including but not limited to employees, consultants, independent contractors, and interns) who have, within six months prior to the start date of the Promotion and thereafter, performed services for American Broadcasting Companies, Inc., any organizations responsible for sponsoring, fulfilling, administering, advertising or promoting the Promotion or supplying prizes, and/or their respective parent, subsidiary, affiliated and successor companies, and immediate family and household members of such individuals, are not eligible to enter or win. "Immediate family members" shall mean parents, step-parents, children, step-children, siblings, step-siblings, or spouses, regardless of where they live. "Household members" shall mean people who share the same residence at least three (3) months a year, whether related or not. Professional artists/writers/actors/directors (defined as those persons who have received compensation for their artistic work/writing/acting/directing) are also not eligible to participate. By entering, participants agree to indemnify, defend, release, discharge and hold harmless American Broadcasting Companies, Inc., its parent, subsidiary and affiliated companies, advertising and promotional agencies and prize suppliers and its respective officers, directors, employees, agents and representatives from any and all claims, liability, including but not limited to negligence and damages of any kind to persons and property, including but not limited to death or personal injury arising out of a participant's participation in the Promotion and/or acceptance or use or misuse of prize. By entering this Promotion, winner grants permission to the Sponsor to use his/her name, videotaped Essay, photograph, likeness, voice, prize information and/or biographical information (city and state only) for programming, publicity and promotional purposes without further compensation, review or approval unless prohibited by law. All federal, state and local laws and regulations apply.
4. Judging. The official judging panel, consisting of designated representatives of American Broadcasting Companies, Inc., will select the top entry from all eligible entries received for each favorite show selected (All My Children, One Life To Live, General Hospital) that most persuasively demonstrate that the entrant is the biggest fan of their favorite ABC Daytime show and most persuasively describes why their job would make for a good swap with their favorite ABC actor. The top three (3) entrants (one for each show) will each win one of the three (3) Grand Prizes. The judging will be based on the following criteria: quality and persuasiveness of entrant's reasoning (40%); overall impact of Essay in communicating why the entrant is the biggest fan (40%); creativity/originality of Essay (20%). In the event of a tie, the entry from among all such tied entries with the higher/highest score in the overall impact of essay criterion will be considered the winner. The judging will be conducted on or about 1/12/2007. Suitability of entrants workplace for hosting a visit by an ABC Daytime TV star will be determined at the sole discretion of the Sponsor.
5. Grand Prize (3 winners - 1 winner per favorite show selected) - Each winner will receive a trip for winner and (1) guest to spend the day on the set of either All My Children (New York); One Life To Live (New York); General Hospital (Los Angeles) with a Daytime TV star (determined by Sponsor), followed by a trip by a Daytime TV star to your place of work to spend the day with you. Trip consists of round-trip coach air transportation for two (2) to New York, NY or Los Angeles, CA (as appropriate and determined at the sole discretion of sponsor) from major commercial airport of Sponsor's sole choosing near winner's residence; 2-night standard hotel accommodations (one room, double occupancy) in a hotel of Sponsor' choice in New York or Los Angeles area (as appropriate); round-trip ground transportation to and from hotel to the taping of soap opera; round-trip ground transportation between New York/Los Angeles airport and hotel; $250 spending money; invitation for (2) to the taping of an ABC soap opera (as determined by Sponsor). (Approximate retail value of each prize: $3,600).
Total Approx. retail value of all prizes: $10,800.00.
Actual final value of trip may be considerably higher or lower based on point of departure and ticket and hotel availability and cost at time of purchase. If Grand Prize winner lives within 150 miles of New York, NY/Los Angeles, CA (as appropriate), he/she will receive, in lieu of air transportation, round-trip local transportation between winner's residence and hotel. In the event Winner's employer does not permit, for any reason whatsoever, the soap start visitor portion of the prize only the remainder of the prize will be awarded.
Grand Prize Winners agree to travel and participate in a backstage tour and attendance of a taping of soap opera as selected and awarded in the sole discretion of the Sponsor (entrant's request or any indication of preference contained in Essay submission may have no bearing on prize awarded) on date to be determined at Sponsor' sole discretion. Winner also agrees to be available for the recording of such attendance and camera crew throughout the experience or prize will be forfeited without further compensation and an alternate winner will be selected (the alternate winner being the entrant who submitted the entry ranked immediately below the disqualified entry in the judging). Winners will have to travel in as little as less than one week from initial notification and definitely before 1 month from award date.
Winners are solely responsible for all other expenses not specified herein, including but not limited to meals, beverages, tips, taxes and hotel incidentals. Winners and guests must travel together on specified itinerary, including same departure date, destination and return date or Grand Prize may be forfeited in its entirety. Accommodation restrictions and blackout dates may apply. All travel dates and arrangements are subject to change, availability and Sponsor's approval. Sponsor is not liable for any expenses incurred as a consequence of flight cancellation/delay. Certain documentation and requirements may be necessary for travel, such as photo identification. Grand Prize winners and their respective guests are solely responsible for any documentation and requirements and determining applicable procedures and restrictions. In addition, the Grand Prize winners may be required to present a valid credit card at the hotel at the time of check-in. Winners and guests must provide own transportation to and from departure airport. Contest is available to over 100 million Internet users.
Potential winners will be notified by e-mail and/or phone. Potential winners will be required to sign and return within 2 business days of receipt an Affidavit of Eligibility, Release and Indemnification, a Publicity Release where allowed by law, as well as other documents that Sponsor may require. Since travel by winner may be required in less than one week from initial notification, if potential winner does not reply to such notification within 2 business days and/or the Affidavit of Eligibility, Release and Indemnification, a Publicity Release and/or any other required documents are not returned by potential winner to Sponsor within specified time period, such winner may be disqualified and an alternate winner selected, time permitting. Winner's guest (if guest is a minor, his/her parent or legal guardian) must sign and return a travel release prior to issuance of documents; if guest is a minor, he/she may only accompany his/her parent or legal guardian (i.e., the Grand Prize winner) on the trip.
No substitution, transfer or cash redemption of prizes except with Sponsor's permission or where required by law. If for any reason prize becomes unavailable, Sponsor may award a substitute prize of equal or greater value. Visit by a soap star, backstage attendance and tour at soap opera tapings have no retail value; in the unlikely event that the taping of winner's chosen soap opera is cancelled for any reason whatsoever or due to time constraints the Grand Prize winner cannot attend the taping, winners agree that Sponsor and their agents shall have no further obligations other than to deliver the trip to Los Angeles or New York (as appropriate) excluding soap opera taping component (i.e., the trip will solely consist of air transportation, hotel accommodations and ground transportation between hotel and Los Angeles/New York airport). Taxes are the sole responsibility of winners, who will receive an IRS Form 1099 reflecting the actual final retail value of their prizes.
SPONSOR MAKES NO WARRANTY, REPRESENTATION, OR GUARANTEE, EXPRESS OR IMPLIED, IN FACT OR IN LAW, RELATIVE TO THE USE OF ANY PRIZE, INCLUDING, WITHOUT LIMITATION, ITS QUALITY, MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.
By entering and if entry is selected as a winner, winner grants American Broadcasting Companies, Inc. the right to use his/her name, voice, likeness, Essay and any footage obtained during the Winner's trip in connection with ABC's programming as may be broadcast, distributed or exhibited in any and all media throughout the world in perpetuity and in advertising and publicizing thereof. However, neither American Broadcasting Companies, Inc. nor the producers of All My Children, One Life To Live, or General Hospital shall have any obligation to film, use or air any winner's appearance. Such use shall be in Sponsor' sole discretion and winners acknowledge that due to scheduling, writing, editing or other production reasons, they may not appear on-air.
Submission of an entry is acknowledgment of and agreement to be bound by all terms and conditions of this Promotion.
